Understanding the legal process

Surrogacy involves two key legal phases, and we guide you through each one:

1. The Surrogacy Contract

Before pregnancy, we:

  • Review screenings, insurance, and pre-contract requirements

  • Draft the contract and explain every term in clear, accessible language

  • Negotiate with the other party’s attorney, ensuring fairness and full understanding

  • Issue legal clearance to the IVF clinic, allowing medical treatment and the embryo transfer cycle to proceed

This essential step protects the parties’ future relationship, ensures clarity, and minimizes risk for all parties.

2. The Parentage Judgment (Pre-Birth Order / “PBO”)

Beginning in the second trimester, we:

  • Prepare and circulate all court documents

  • File with the proper court and track the case through judgment

  • Provide the signed Judgment to the birthing hospital, ensuring the intended parent(s)' names appear on the original birth certificate

This phase legally recognizes the Intended Parents as the child’s parents — securing their rights from the moment of birth.

Important Considerations We Help You Navigate

Every surrogacy journey is unique. We help parties reach alignment on every critical topic.

These conversations can be emotional and complex — our role is to guide the discussion with clarity, compassion, and advocacy for our clients’ needs and interests.

Has the surrogate’s health insurance been reviewed for surrogacy coverage?

Have all parties completed psychological evaluations?

What level of communication and contact is expected during pregnancy?

How many embryos will be transferred per attempt?

What are the shared expectations regarding termination, selective reduction, and medical decision-making?

Our approach is:

  • Compassionate

we honor the emotional side of the process

  • Educational

    less legal jargon, less confusion

  • Efficient

    proactive communication to avoid delays

  • Protective

contracts and filings designed to safeguard everyone involved

Your surrogacy journey deserves legal guidance that is both experienced and deeply personal.
